Terms and Conditions of Sale (T&Cs)

1. Product Unavailability

In the event that the ordered product(s) is/are unavailable, NUSHKA will inform the Customer by email, phone, or regular mail within a maximum of 48 hours following order confirmation. The Customer may then choose to:

*accept a delivery delay for the ordered product(s);

*request cancellation of the order with a full refund of the amount paid;

*request delivery of an equivalent or similar product, with a price adjustment either upwards or downwards depending on the replacement product chosen.

If the replacement product is refused, the order will be cancelled and refunded. No other claims or compensation may be requested.

2. Claims for Damage or Non-Conformity

The Customer has a maximum of 24 hours after receipt of the goods to report any loss, damage, or non-conformity. All claims must be made in writing (email) using the contact details provided and must be accompanied by evidence (photos, reports, etc.). Claims made after this period will not be accepted.

Returns are only accepted after prior agreement from NUSHKA and provided the goods are in their original condition, unused, and properly packaged.

3. Right of Withdrawal

In accordance with applicable Moroccan law, the Customer has a period of 7 calendar days from the date of receipt of the goods to exercise their right of withdrawal, except if the goods have been opened or damaged by the Customer.

To exercise this right, the Customer must notify NUSHKA in writing (email) using the contact details on the website. The product must be returned in its original condition and packaging.

Return shipping costs are borne by the Customer, except in cases of defective or non-compliant products.

4. Order Cancellation

Any cancellation request must be sent in writing (email) before the goods are shipped. In case of cancellation after shipment, all costs incurred remain payable by the Customer.

Cancellation does not exempt the Customer from payment for services already rendered.

5. Delivery

Delivery times are given for information purposes only and do not bind NUSHKA in case of delay, especially in cases of force majeure or circumstances beyond its reasonable control.

Delivery is made to the address provided by the Customer at the time of order. The Customer agrees to be available to receive the goods or to designate an authorized third party.

In case of absence during delivery, NUSHKA reserves the right to charge additional fees for a second delivery attempt by its partner ARAMEX.

6. Refund Terms

Refunds will be made within a maximum of 14 days from the receipt of the withdrawal notification, subject to receipt of the returned product or proof of shipment.

The refund includes the price of the product and standard delivery charges, excluding any additional fees chosen by the Customer. Refunds will be made using the same payment method as the original purchase, unless otherwise agreed.

7. Force Majeure

NUSHKA shall not be held liable for failure to perform its contractual obligations in the event of force majeure, i.e., unforeseeable, irresistible events beyond its reasonable control (e.g., natural disasters, strikes, pandemics, etc.).

The occurrence of a force majeure event suspends the obligations of the parties for the duration of the event.

8. Governing Law and Jurisdiction

In the event of a dispute relating to the interpretation or execution of these T&Cs, the parties will attempt to reach an amicable solution. Failing that, these T&Cs are governed by Moroccan law.

Any dispute will be subject to the exclusive jurisdiction of the Commercial Court of Agadir.
